Vancouver Real Estate Lawyers Helping You
Homeowners associations are responsible for the administration of the covenants, conditions, and restrictions that govern a community of homeowners. These associations are also tasked with handling other issues that affect the community, such as the implementation of new or existing city regulations.
At Beaty Hatch PC, we have a wealth of experience and knowledge in the broad array of issues that may arise during the course of providing legal advice to a homeowners association (HOA). Our Vancouver real estate lawyers provide trusted and reliable legal counsel for real estate matters throughout southwest Washington and Oregon. When necessary, we are also aggressive advocates in mediation, arbitration, litigation, and appeals.
How We Help HOAs
Homeowners associations obtain their powers and duties from their governing documents. Typically, an HOA will be governed by a declaration of covenants, conditions, and restrictions (CC&Rs) that will dictate the formation of an HOA as a non-profit corporation. The HOA will operate according to a set of bylaws and through an elected board of directors. The board may pass resolutions and enact rules for the enforcement of CC&Rs.
Beaty Hatch can assist HOAs in revising and updating governing documents, enforcing their rules, collecting unpaid dues, and resolving neighbor-to-neighbor disputes. Our goal in all areas of real estate is to optimize results, protect our clients' interests, minimize the risk of future problems, and maintain your property values.
Modification of CC&Rs
In some cases, CC&Rs may contain provisions that some homeowners want to change. For example, there may have been a long-standing "no pet" or "no leasing" rule. Generally speaking, CC&Rs contain a process by which a specific provision can be modified. These processes usually involve a majority vote in favor of the change. In some cases, there is a quorum rule, which means that a certain percentage of the association members must vote to alter the CC&Rs.
A knowledgeable attorney can help determine the specific modification process and any exceptions, and can also make sure the suggested change is in compliance with federal, state, and local laws.
